Social Security Disability in Puerto Rico

Social Security Disability in Puerto Rico

What is Social Security Disability?

Social Security Disability Insurance (SSDI) is a federal program that provides benefits to people who cannot work due to a medical disability expected to last at least one year or result in death. To qualify, you must have worked and contributed to the Social Security system for enough time and have a condition that meets the Social Security definition of disability.

The Social Security Disability program helps people who can't work because of a disability and their families by giving them some money to replace what they used to earn. Unlike some other programs or private insurance, Social Security has strict rules about who can get disability benefits. Social Security doesn't give money for short-term or less serious disabilities.

To get benefits, a person must have a really serious medical problem that has lasted or is expected to last for at least a year or more. This medical problem must be so severe that the person can't do the work they used to do, and they can't learn to do a different job either.

Social Security's rules are so strict that the people who get disability benefits are some of the most seriously ill people in the country. The specific eligibility rules for Social Security disability differ from those of private plans or other government agencies like the Veteran's Administration. Call us today at 787-344-9219 to discuss your medical conditions.

Social Security Disability Guide

Social Security Disability Attorney in Puerto Rico

Qualification Requirements

  1. Work History: You must have worked in jobs covered by Social Security and accumulated enough work credits. Generally, you need 40 credits, 20 of which must have been earned in the last 10 years before your disability began. Younger workers may qualify with fewer credits.
  2. Medical Condition Meeting Disability Criteria: Your condition must be severe enough to prevent you from performing any substantial gainful activity. The Social Security Administration (SSA) has a list of medical conditions considered severe enough to prevent a person from performing substantial work.
  3. Duration of Disability: Your condition must have lasted or be expected to last at least one year or result in death.

Application Process

  1. Filing an Application: You can apply for SSDI benefits online, by phone, or in person at a local Social Security office.
  2. Initial Review: Once you submit your application, the SSA will review your work history and Social Security credits to determine if you qualify technically.
  3. Medical Assessment: If you meet the technical requirements, your application will be sent to a state agency called Disability Determination Services (DDS), which will evaluate your medical condition. DDS will review your medical records, and if necessary, request that you undergo an additional medical examination.
  4. Decision: DDS will make a decision on whether your condition meets the Social Security disability criteria. If your application is approved, you will begin receiving benefits. If it is denied, you have the right to appeal the decision.

Appeals

If your application is denied, you have 60 days from the date of the decision to request an appeal. The appeal process has four levels:

  1. Reconsideration: A different reviewer at DDS will review your case again.
  2. Hearing before an Administrative Law Judge: If your application is denied again, you can request a hearing before an Administrative Law Judge (ALJ), who will review your case and make an independent decision.
  3. Appeals Council Review: If you disagree with the ALJ's decision, you can request a review by the Social Security Appeals Council.
  4. Federal Court Action: If the Appeals Council also denies your application, you can file a lawsuit in a federal court.

Real Life Examples and Cases

  1. Juan's Case: Juan worked for 25 years as a carpenter, but he developed severe arthritis that prevented him from continuing to work. After filing his SSDI application, he was initially rejected, but upon reconsideration, his application was approved due to the severity of his condition.
  2. Maria's Case: Maria was diagnosed with multiple sclerosis. Although she could initially work, the progression of her disease eventually prevented her from performing any work activity. After filing her SSDI application, she was approved due to the detailed documentation of her condition and its impact on her ability to work.

Tips for a Successful Application

  1. Detailed Medical Documentation: Make sure to provide all relevant medical documentation supporting your disability condition.
  2. Consistent Follow-Up: Stay in touch with the Social Security office and ensure they have all the necessary information for your case.
  3. Consider Legal Assistance: A lawyer specializing in Social Security disability can help you navigate the process and increase your chances of success.
  4. Be Patient: The application and appeal process can be long and frustrating. Stay calm and persist with your case.

Summary

In summary, qualifying for SSDI benefits requires meeting certain work and disability criteria. While the process can be complex and challenging, a clear understanding of the requirements and a proactive approach can help you navigate the system and obtain the support you need.
